Refund, Return, Replacement & Cancellation Policy
Including SNAP / EBT Transactions

This policy applies to all purchases, including those paid for with Supplemental Nutrition Assistance Program (SNAP) / EBT benefits.
1. Final Sale / No Returns
Due to the perishable nature of our food products, ALL SALES ARE FINAL.

We do not accept returns or exchanges of food items under any circumstances.

This applies to all payment methods, including SNAP / EBT.
2. SNAP / EBT Compliance Statement
In accordance with USDA SNAP regulations, the following conditions apply to all SNAP / EBT purchases:

SNAP benefits may only be refunded or replaced when food is damaged, spoiled, or rendered unfit for human consumption due to circumstances beyond the customer’s control.

SNAP benefits may NOT be refunded:

For taste preferences
-
For customer error
-
For missed deliveries
-
For shipping delays or carrier issues
-
For refusal of delivery
-
For incorrect or incomplete shipping information
-

SNAP refunds cannot be issued as cash, store credit, or non-food items.

Any approved SNAP refund will be returned to the original EBT account only, as required by federal law.
3. Eligible Refunds or Replacements (All Orders)
Refunds or replacements are not guaranteed and are evaluated solely at our discretion on a case-by-case basis.
Eligibility requires documented proof that products were:

Spoiled
-
Thawed beyond safe temperature
-
Physically damaged during transit
Required Documentation (No Exceptions):
Customers must submit clear photographic evidence of:

The entire order as received
-
Product condition
-
Insulated packaging
-
Ice packs and/or dry ice
-
Shipping box (interior and exterior)
All documentation must be submitted immediately upon delivery.

Failure to provide complete documentation will result in automatic denial.
4. Packaging, Temperature & Food Safety
Orders are packed in insulated containers with ice packs and/or dry ice to maintain safe temperatures during transit.

If products arrive cool to the touch or at/below 40°F, the order is considered safe and acceptable.

Customers are responsible for promptly refrigerating or freezing items upon delivery.
-
Products left unattended after delivery are not eligible for refunds or replacements.
All orders are photographed and documented prior to shipment to protect against fraudulent claims.
5. Shipping Liability & Third-Party Carriers
Once an order leaves our facility, responsibility transfers to the shipping carrier.
We are not responsible for:

Lost packages
-
Delayed shipments
-
Carrier handling errors
-
Theft after delivery
-
Packages marked “Delivered” by the carrier
-
Delivery issues in apartments, gated communities, or multi-unit dwellings
Customers must contact the carrier directly regarding delivery issues.

6. Address Accuracy
Customers are solely responsible for providing accurate and complete shipping information.

Orders shipped to incorrect or incomplete addresses void all guarantees

No refunds or replacements will be issued for address errors
7. Refused Deliveries & Returned Shipments

Refusing delivery does not cancel an order

Returned or refused shipments are not eligible for refunds or replacements

Customers remain responsible for all product and shipping costs

This applies to SNAP / EBT orders
8. Order Cancellations
Due to immediate order processing and perishable inventory controls:

Orders cannot be canceled once submitted
-
This includes SNAP / EBT purchases

No exceptions will be made
9. Limitation of Liability
To the maximum extent permitted by law:

Our liability is limited to the purchase price of the affected product only

We are not liable for consequential, incidental, or indirect damages
10. Food Consumption Responsibility & Assumption of Risk
By purchasing and consuming our products, the customer acknowledges and agrees that:

The customer is solely responsible for the proper handling, storage, preparation, and consumption of all food products purchased.

The customer assumes all risks associated with consuming food, including but not limited to:
-
Food-borne illness
-
Allergic reactions
-
Choking hazards
-
Sensitivities or dietary reactions
-
Improper handling, storage, reheating, or preparation after delivery

We do not provide medical, dietary, or nutritional advice, and customers are responsible for determining whether products are appropriate for their individual health needs or restrictions.
11. Allergy & Ingredient Disclosure

Products may be processed, packed, or handled in facilities that also process common allergens, including but not limited to:

Milk
-
Eggs
-
Wheat
-
Soy
-
Peanuts
-
Tree nuts
-
Shellfish
-
We do not guarantee that products are free from allergens or cross-contamination.
Customers with food allergies or sensitivities purchase and consume our products at their own risk.
12. Limitation of Liability - Food-Related Claims
To the maximum extent permitted by law, we are not liable for:

Illness, injury, or adverse reactions arising from food consumption

Allergic reactions or sensitivities
-
Choking incidents
-
Improper storage or handling after delivery
-
Consumption contrary to food safety guidelines
Our total liability, if any, is strictly limited to the purchase price of the affected product.
13. Indemnification
By placing an order, the customer agrees to indemnify, defend, and hold harmless Guinther's Co., its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from:

Consumption of purchased food products

Failure to follow storage or food safety instructions

Allergic reactions or health-related issues
14. Agreement to Terms
By placing an order, the customer:

Acknowledges this policy
-
Agrees to all terms stated herein
-
Confirms compliance with SNAP regulations (if applicable)
